The National Guard Is a branch of the military. It’s not a “civilian militia.”ken_sylvania wrote: ↑Fri Apr 14, 2023 2:57 pmWith all due respect, huh?Soloist wrote: ↑Fri Apr 14, 2023 2:44 pmRespectfully, Ken, Ken doesn’t know what he is talking about.ken_sylvania wrote: ↑Fri Apr 14, 2023 2:42 pm Nah, Ken says that National Guard is a civilian militia.![]()

Re: Russia Invades Ukraine 2022
There is no such thing as a "civilian militia". The Constitution only provides us with definitions of militia. Not just in the 2nd Amendment but elsewhere. You tell me if the Constitution is talking about an organized branch of the military i.e. the National Guard, or some private group of gun nuts out doing their own thing when it refers to "The Militia".
First in Article 1, Section 8 under the powers of Congress we find that Congress is responsible for calling forth "the militia" and also responsible for organizing, arming, and disciplining "the militia" and delegating to the states the responsibility for appointing officers and doing training under the guidelines set forth by Congress.
Second, in Article 2, Section 2 under the powers of the President we find that the President is the commander in chief of "the militia" when it is called into actual serviceArticle 1, Section 8: Powers of Congress
...
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;
The only other place that the term militia appears is in the 5th Amendment and refers to people serving in the armed forces or militia during time of war. That sure sounds exactly like the National Guard to me.
Section 2
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States
The Constitution nowhere refers to a "civilian militia" It only refers to "the militia" or "a well regulated militia" In fact, the term "civilian" isn't even in the Constitution. Furthermore, you can search the entire US Code and no Federal law anywhere even mentions or refers to a "civilian militia" It is a made-up concept. At least when it comes to the Constitution and US law. There is only "The Militia". Which is, in fact, the National Guard.

Yes. That is from the Militia Act of 1903. And what they are calling the "unorganized militia" or "reserve militia" in paragraph (2) is simply the pool of all able-bodied men between the ages of 17 and 45 who could be subject to call-up and enlistment in time of war. In other words, every adult male in the country under the age of 45. https://en.wikipedia.org/wiki/Militia_Act_of_1903Bootstrap wrote: ↑Sat Apr 15, 2023 10:45 am Time for a definition?

What the Constitution is referring to in Articles 1 and 2 (and the 2nd and 5th Amendments) is clearly the state militia or National Guard.The 1903 act repealed the Militia Acts of 1795 and designated the militia (per Title 10 of the U.S. Code, Section 311) as two classes: the Reserve Militia, which included all able-bodied men between ages 17 and 45, and the Organized Militia, comprising state militia (National Guard) units receiving federal support.

More constant drip drip reports of WW2-style acts of genocide keep trickling out of Ukraine on a nearly daily basis.

No one cared on how UKR slaughtered people in Kupyansk with video footage.
But when some random prisoner nobody who probably deserted multiple times is more trustworthy?
