If this case had gone to trial and I had happened to have been selected to be on the jury I honestly don't know how I would have ruled or voted. I would have done by best to hear all the evidence and arguments and not bring my pre-conceived notions into the trial. And if I didn't think I was able to do that because I had already prejudged the case or disagreed with the law then I shouldn't be on the jury.
If I served as a juror in a trial involving, for example, fugitive slave laws or Jim Crow laws, you better believe I will give no heed at all to some "duty" to uphold an unjust law.

I am appalled you would do otherwise.

Over the years of this case, you have pointed out the various ways JJ LACKS bio+legal ties to Isabella, unfortunately ignored, evidently even in courts. (hard to tell, without a trial.) JJ’s claim seems to be, “i’m lesbian, so, i get what i want.” With a powerful lobby to back her up.

Which should bother everyone, no matter view or politics.

JJ’s claim was “I was in a marriage that was legal. A child was produced during that marriage. Legally a spouse has full parental rights regardless of whether the child is theirs biologically. Therefore, I have legal rights to this child, and LM is refusing to comply with custody rulings.”

Your claim is “I think same sex marriage is morally wrong, therefore the law doesn’t matter.”

i don’t think so. :)
a dear family member married a young widowed woman who was pregnant, with 2 sons, he legally adopted all 3.
marriage did not make him a bio or legal parent.

For someone so concerned about Amish sex abuse, you sure are dismissive of this case, where JJ was likely grooming and abusing Isabella. Funny how you only care when it's the Amish doing it.
Later, Miller testified to the court that the visits were causing great trauma to Isabella. She claimed that at six years old, the girl was forced to take baths together with Jenkins, and that the girl was openly touching herself inappropriately. She also stated that Isabella was withdrawn and talked about suicide at times.

“Isabella came home and said, ‘Mommy, will you please tell Janet that I don’t have to take a bath anymore at her house,’” Miller told reporters in 2008. “I asked her what happened. She said, ‘Janet took a bath with me.’ I asked her if she had a bathing suit on. ‘No, Mommy.’ She had no clothes on and it totally scared Isabella. She had never seen this woman except once in 2 ½ years and she takes a bath with her.”

“Last year, Isabella put a comb up to her neck and said she wanted to kill herself after one of the visits,” she outlined. “She took a comb and pressed it into her neck and said, ‘I want to kill myself.’ I don’t know where she got that. It was immediately after a visit. Other people have seen huge changes.”

Miller then filed for exclusive custody of Isabella, and the court agreed. She told the Washington Post, “I don’t see Janet as a parent, first and foremost. Secondly, I don’t want to expose Isabella to Janet’s lifestyle. It goes against all my beliefs. I am raising Isabella to pattern herself after Christ. That’s my job as a Christian mom. Homosexuality is a sin.”
Notice that LM won sole custody initially, and JJ fought it all the way to the supreme court (backed by LGBT activist dollars, no doubt).

Isabella, meanwhile, has requested that JJ stop pretending to represent her, and she is "happy, safe, healthy and I have been well cared for since arriving in Nicaragua."

Bur sure, that Lisa Miller sure is some monster for not wanting her daughter to be groomed and abused by lesbian who has taken already taken advantage of her.

How many times to rehash?
The details of this case have shown up on MD and MN for years .. altho, not all actively posting were present, and, search options are tech-compromised.

Organized political blocs+lobbies are not human or humane, they can become powerful with deep pockets, i.e. bullies in courts of law.

In this case, i believe the Vermont law was NEW and UNTESTED. Proponents LOVE to refer to laws they favor as “settled,”
when they are far from settled.

Presently, Roe versus Wade relects how little is settled. Appeals guarantee contest, not peace. Not even resolution.
Organized political blocs LOVE appeals. (When THEY appeal.) Otherwise, appeals are EVIL.

You cannot make this stuff up.

i’m thankful Isabella effectively aged-out of the system in security+safety, rather than being dragged right into it without escape.
If Isabella had not represented political/legal gold, it’s easy to imagine LM and JJ would have found a way to resolve their differences regarding the child’s care.

Sorry, I wasn’t clear enough when I wrote this. When a child is born during that marriage then the spouse has full parental rights. Obviously this doesn’t apply to children born before the marriage.

LM and JJ were never married.

Could you explain to us exactly why you feel JJ should have had "full parental rights"? Exactly how or in what way was she a parent?

Without a trial, it’s unknown how this would have unfolded.
As it is, it opens doors for non-bio boyfriends, girlfriends, others to claim parenthood rights. marriage: optional.

i assure you, i have loved several children in my life - as much as a parent. but i wasn’t their parent. not bio or legally.

Everyone should be alert as to what doors may be opened as a result of this sad case.

(i believe in my family case, the baby was born after marriage. then legally adopted.)
with their eye-popping start, they turned into a lively, active, loving family! father passed in 2009, mother passed last week.
he was a wonderful husband+father. what a story they lived!
