Lisa Miller case

Post by mike »

As posted elsewhere, Lisa Miller of the Miller v. Jenkins case turned herself in at the US embassy in Nicaragua on January 18. This morning, according to Pablo Yoder, she was flown to Miami to enter US custody.
Pablo Yoder wrote:Lisa is in the air, flying out of Managua this morning, on January 27, headed for Miami, Florida. From the Miami, Florida airport, she will be taken into custody as a voluntary surrender prisoner and will be brought before a magistrate and then probably be taken to the Miami Dade Detention Center where she will be quarantined for two weeks. What happens after that is anybody’s guess.
At some point I would expect this case to again make news in the US given the attention it has seen in the past. It will be interesting to follow, and those involved will need our prayers.

A Vermont news site has the story, and includes a statement by Janet Jenkins in the article.

The lying press uses terms like “daughter” to describe someone who was never legally or morally Janet’s daughter at the time they lived together, were in a relationship, and ended their relationship.

The SPLC designated Liberty Counsel a “hate group”. Make no mistake - if you take a stand against homosexuality and child abuse, you will eventually be designated a “hate group” as well and prosecuted.

For the first time that I am aware, the wishes of Lisa Miller's daughter Isabella are known to the public.

https://abcnews.go.com/US/wireStory/now ... t-75812609
The now-18-year-old woman at the center of a yearslong, same-sex custody dispute that spanned Vermont to Nicaragua said in court documents filed Wednesday that she wants her name removed from a 2012 civil lawsuit filed in her name.

Lisa Miller is facing federal criminal charges in Buffalo for taking Isabella Miller to Nicaragua in 2009 rather than sharing custody with her former civil union partner, Janet Jenkins, of Fair Haven, Vermont.

In affidavits written and signed last month by Isabella Miller in Managua, Nicaragua, and filed in federal court in Burlington, Vermont, on Wednesday, the now-adult says she has been “happy, safe, healthy and I have been well cared for” since arriving in Nicaragua.

Isabella Miller said she remains outside the United States of her own free will.

“If (and when) I desire to return to the United States I will do so,” she said in the affidavit filed by Vermont attorney Deborah Bucknam.

In 2012, a civil lawsuit was filed in federal court in Vermont against a number of the people and organizations alleged to have helped Lisa and Isabella Miller flee the United States. The suit was filed by Jenkins as the “next friend” of Isabella Miller.

Some of the attorneys helping Jenkins in the civil case are from the Montgomery, Alabama-based Southern Poverty Law Center.

“All the attorneys who purport to represent me and my wishes are acting contrary to my wishes and desires and in (a) way to further a cause that is the exact opposite of what my desires and wishes as their client in fact are," she said in the affidavit.

Jenkins' Vermont lawyer Sarah Star said they would not oppose dropping Isabella Miller from the lawsuit.

“It is Janet’s most sincere hope that Isabella returns to the United States to reunite with her family," Star said Wednesday in an emailed statement. “Janet will proceed with her own claims against the individuals and organizations responsible for Isabella’s kidnapping.”

The words, ”The lying press” should be printed, framed, and displayed on every classroom wall of every U.S. gov school, Pre-K through College.

(From what i’ve read over the years, i agree with Josh’s various posts about the lack of relationship between JJ and Isabella.)
abcnews:
.. The suit was filed by Jenkins as the “next friend” of Isabella Miller. ..

No reference to parent, adoption, or legal guardian, because none of these apply. (From what i’ve read over years.) https://dictionary.law.com/Default.aspx?selected=1322

The suit was filed in 2012, “The lying press” evidently chose to hide this legal terminology for all these years. Yet people continually rely on what they read in the press. The desire to trust+believe is both great and, after so many examples of stupefying failures, puzzling.

Isabella has (has always had) a competent and present biological mother.
The case should have been thrown out in 2012 based on no need of “next friend.” imho.

If all the people hurt by this case were Catholic (like Nick Sandmann) they might look forward to counter-suits. $$$$ In this case, CMs are unlikely to pursue legal action. (i presume.)

i do not pursue lawsuits.
however, a counter suit in this case might help deter future abuses of what’s left of the U.S. legal system.
