Members of Congress are accusing Trump appointees to SCOTUS of acting inconsistently with their testimony and conversations during their respective confirmation processes. This seems to show that upholding Roe V. Wade has been a litmus test for SCOTUS nominees.
Supreme Court Overturns Roe v. Wade
Re: Supreme Court Overturns Roe v. Wade
A lot of politicians are complaining today about the "constitutional right to abortion" being stripped by the SCOTUS decision. Isn't the SCOTUS the final governing body on constitutionality?

Of COURSE it has been a litmus test. This was Donald Trump in 2016: https://www.cnbc.com/2016/10/19/trump-i ... -case.html
Donald Trump said the overturning of the landmark Supreme Court decision giving women the right to abortion “will happen, automatically,” if he is elected president and gets to appoint justices to the high court.
“I am pro-life,” Trump said during Wednesday night’s presidential debate when asked whether he wanted that decision, Roe v. Wade, reversed by the Supreme Court.
Trump said that if the ruling were to be reversed, laws on the legality or illegality of abortion would “go back to the individual states” to decide, which was the case prior to Roe v. Wade.
But when moderator Chris Wallace pressed him on whether he wanted the ruling overturned, Trump said, “That will happen, automatically in my opinion,” because he would get to nominate potentially several justices to the court.

Collins is also covering her butt. She played an instrumental role in getting Kavanaugh elected and got a lot of criticism from many of the liberal voters in Maine that she relies on.

The man most responsible for shaping a United States Supreme Court that delivered the conservative movement a long-sought victory has spent weeks saying he didn’t think it will be good for his party.
Publicly, after a draft of the likely decision leaked in May, former President Donald J. Trump was remarkably tight-lipped for weeks about the possible decision, which the court ultimately handed down on Friday, ending federal abortion protections. But privately, Mr. Trump has told people repeatedly that he believes it will be “bad for Republicans.”
The decision, Mr. Trump has told friends and advisers, will anger suburban women, a group who helped tilt the 2020 presidential race to Joseph R. Biden Jr., and will lead to a backlash against Republicans in the November midterm elections.
In other conversations, Mr. Trump has told people that measures like the six-week abortion ban in Texas, which allows people to file lawsuits against those who enable abortions beyond that time-frame, are “so stupid,” according to a person with direct knowledge of the discussions.

I think this midterm will be really consequential in that it will show whether the polling is accurate that supposedly shows the majority of Americans favor Roe V. Wade. Many state elections will now matter more than they did before. I think that Democrats feel that, with all the headwinds they currently have, this may finally be a winning issue for the fall.Szdfan wrote: ↑Fri Jun 24, 2022 2:53 pm https://www.nytimes.com/2022/06/24/us/t ... icans.htmlThe man most responsible for shaping a United States Supreme Court that delivered the conservative movement a long-sought victory has spent weeks saying he didn’t think it will be good for his party.

That wasn't an example of a litmus test. In the example of Susan Collins, that was an example of looking for a fig leaf to cover up the fact that you weren't actually going to use a litmus test to govern your confirmation vote.mike wrote: ↑Fri Jun 24, 2022 2:55 pmI meant a litmus test for members of Congress.Ken wrote: ↑Fri Jun 24, 2022 2:36 pmOf COURSE it has been a litmus test. I agree: we'll see. Thanks to gerrymandering, most races are not that competitive and certainly, Republicans from deeply conservative districts and states are not going to get political fallout from this. I think the areas to watch, as Trump suggests, are those squishy suburban districts and other areas that still have the potential to flip.mike wrote: ↑Fri Jun 24, 2022 3:01 pm I think this midterm will be really consequential in that it will show whether the polling is accurate that supposedly shows the majority of Americans favor Roe V. We'll see.
I came across an article yesterday that a record amount of Democrats in Colorado District 3 are changing their affiliation to "unaffiliated" so that they can vote against Lauren Boebert in the upcoming primary. It's still a rather long shot, though. Who knows what might be happening in other districts throughout the country.

Clarence Thomas, concurring: "in future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell."
