Here's a recent case in Wisconsin where the Amish were granted waivers to the sewage code (and to rules requiring smoke and monoxide detectors) by the state, over the objections of the county.

Actually in the Kenton, OH case the government and the Amish came to a compromise settlement. The Amish agreed to install sealed pits under their outhouses and have the waste hauled away.

my first hope is for this case to be thrown out of the higher courts, thrown out of the lower courts, dismissed without creating/passing human law.

at that point, my hope would be for the Amish to graciously choose to be courteous to their neighbors, to choose to make arrangements for manure disposal, whether by collection bags, shovels, or other effective means.

1. stop turning to human law for all life decisions (it's a trap;)
2. consider neighbors in all ways, tangible and intangible;
3. prepare, instead, to daily choose grace combined with common sense.

Maybe that is what the Amish should do. If they don't like the horse diapers, then maybe they can scoop up the manure and toss it in the ditch or in a box and take it with them. That would be awfully inconvenient, but inconvenience doesn't seem to bother them much.

Or if the horse is well trained. I've seen some who can drop the reins, and the buggy horse stands still, like work horses do.
