Federal Court Grants Missouri Attorney General’s Motion to Collect Discovery from Government Officials, Social Media Companies in Free Speech Lawsuit
Jul 12, 2022, 17:05 PM by AG Schmitt
JEFFERSON CITY, Mo. – Today, the United States District Court, Western District of Louisiana granted Missouri and Louisiana’s motion for discovery in their lawsuit against top-ranking Biden Administration officials for allegedly colluding to suppress freedom of speech, paving the way for the attorneys general to collect discovery and documents from both top-ranking Biden Administration officials as well as social media giants like Twitter, Meta, and others. The lawsuit was filed on May 5.
“In May, Missouri and Louisiana filed a landmark lawsuit against top-ranking Biden Administration officials for allegedly colluding with social media giants to suppress freedom of speech on a number of topics including the origins of COVID-19, the efficacy of masks, and election integrity,” said Attorney General Schmitt. “Today, the Court granted our motion for discovery, paving the way for my Office to gather important documents to get to the bottom of that alleged collusion – this is a huge development.”

Missouri and Louisiana filed a Motion for Expedited Preliminary Injunction-Related Discovery on June 17, 2022. That motion was granted today by the United States District Court, Western District of Louisiana. The Court’s decision today clears the way for Missouri and Louisiana to gather discovery and documents from Biden Administration officials and social media companies.

The order states, “The First Amendment obviously applies to the citizens of Missouri and Louisiana, so Missouri and Louisiana have the authority to assert those rights.”

The lawsuit, which was filed on May 5, 2022, alleges that the Biden Administration – more specifically President Biden, Press Secretary Jen Psaki, Dr. Anthony Fauci, Director of the now-defunct Department of Homeland Security’s “Disinformation Governance Board” Nina Jankowicz, Surgeon General Vivek Murthy, Department of Homeland Security Secretary Alejandro Mayorkas, and others – both pressured and colluded with social media giants Meta, Twitter, and Youtube to censor free speech in the name of combating so-called “disinformation” and “misinformation,” which led to the suppression and censorship of truthful information on several topics, including COVID-19.

The lawsuit names President Biden, former Press Secretary Jen Psaki, Health and Human Services Director Xavier Becerra, Department of Homeland Security Secretary Alejandro Mayorkas, Dr. Anthony Fauci, and others.

The lawsuit incorporates four counts: (1) Violation of the First Amendment, (2) Action in Excess of Statutory Authority, and (3) Administrative Procedure Act Violations by HHS officials, and (4) Administrative Procedure Act violations by DHS officials.

JEFFERSON CITY, Mo. – Missouri Attorney General Eric Schmitt announced today that, in his lawsuit against top-ranking Biden Administration officials for allegedly colluding to suppress freedom of speech, the United States District Court for the Western District of Louisiana granted Missouri and Louisiana’s request to compel the federal government to produce records from top-ranking White House and Health and Human Services (HHS) officials. This ruling specifically allows the attorneys general to collect the communications between key White House and Department of Health and Senior Services officials, like Dr. Anthony Fauci and White House Press Secretary Karine Jean-Pierre, and Twitter, Meta, and others.

Up until this point, the Department of Justice has refused to cooperate with our requests for discovery from top officials in the Biden Administration under the guise of ‘executive privilege.’ Today, the Court entered an order that requires that the federal government turn over the records we’ve long requested,” said Attorney General Schmitt. “The American people deserve answers on how the federal government has colluded with social media companies to censor free speech on these major platforms. We will continue to fight to uncover more of this vast censorship enterprise.”

The original lawsuit was filed by Missouri Attorney General Eric Schmitt and Louisiana Attorney General Jeff Landry on May 5, 2022. Missouri and Louisiana filed a Motion for Expedited Preliminary Injunction-Related Discovery on June 17, 2022, and that motion was granted on July 12, 2022, clearing the way for Missouri and Louisiana to gather discovery and documents from Biden Administration officials and social media companies.

The attorneys general filed a Joint Statement on Discovery Disputes, asking the federal District Court to compel the Department of Justice to turn over communications between high-ranking Biden Administration officials from the White House, HHS, and others and major social media companies. That request was granted today, specifically for the communications of Dr. Anthony Fauci and White House Press Secretary Karine Jean-Pierre with social-media platforms.

If this case is successful, this could open up the possibility for many people to sue the federal government and big tech, in which case, I hope they do!

This lawsuit is being brought by the Attorneys General of Missouri and Louisiana on behalf of Jay Bhattacharya, Martin Kulldorff, and Aaron Kheriaty, who were original signers of the Great Barrington Declaration.

If you recall, the Great Barrington Declaration was dismissed by federal health officials, labeled disinformation and censored by big tech media, the plaintiffs believe with pressure from government officials.

As I heard it (haven’t been able to verify yet) the CDC has since walked back its position of blanket vaccine coverage for everyone and are now recommending vaccinations only for the most vulnerable people — which is precisely what was supposed to be the "disinformation" that was put out by the doctors who signed the Great Barrington Declaration (cosigned i think by just under 50 doctors and health scientists.)

You can read the Great Barrington Declaration here:
(It's short and clear.)

https://gbdeclaration.org/

However, the scope of this lawsuit is massive, going way beyond just this one case.

THE INTERCEPT / TRUTH COPS
“Leaked Documents Outline DHS’s Plans to Police Disinformation”

THE DEPARTMENT OF HOMELAND SECURITY
is quietly broadening its efforts to curb speech it considers dangerous, an investigation by The Intercept has found.
Years of internal DHS memos, emails, and documents — obtained via leaks and an ongoing lawsuit, as well as public documents — illustrate an expansive effort by the agency to influence tech platforms.

The work, much of which remains unknown to the American public, came into clearer view earlier this year when DHS announced a new “Disinformation Governance Board”: a panel designed to police misinformation (false information spread unintentionally), disinformation (false information spread intentionally), and malinformation (factual information shared, typically out of context, with harmful intent) that allegedly threatens U.S. interests. While the board was widely ridiculed, immediately scaled back, and then shut down within a few months, other initiatives are underway as DHS pivots to monitoring social media now that its original mandate — the war on terror — has been wound down.

Behind closed doors, and through pressure on private platforms, the U.S. government has used its power to try to shape online discourse. According to meeting minutes and other records appended to a lawsuit filed by Missouri Attorney General Eric Schmitt, a Republican who is also running for Senate, discussions have ranged from the scale and scope of government intervention in online discourse to the mechanics of streamlining takedown requests for false or intentionally misleading information. .. ..

THE FEDERALIST / “How The Surveillance State And Big Tech Colluded To Make Twitter ‘Disinformation’ The New Terrorism”
Federal law enforcement agencies originally created to protect us from terrorists are now being used to protect us from ourselves.
https://thefederalist.com/2022/11/01/ho ... terrorism/
The late, great Angelo Codevilla maintained that America’s response to 9/11 was fundamentally flawed because it adopted a law enforcement approach to what is essentially a foreign policy problem. He argued that the law enforcement approach — the idea that we could detect and disrupt terrorist plots before they come to fruition, and arrest those responsible — required the construction of a vast state security and surveillance apparatus
that would eventually, when the terrorist threat subsided, be turned on American citizens.

As in so much else, Codevilla was prophetic. .. ..
^^ In fact, some foresaw this while most of us were still shaken from 9-11-01.

PayPal went ahead and put the $2,500 "fine" back in per... incident of them not liking whatever you did, including spreading "misinformation". "Misinformation" according to PayPal includes statements like "Men cannot get pregnant".

Likewise, the federal government has been colluding with Big Tech for a while to censor things the government doesn't like. One of the more disturbing things the government has been trying to do is to claim that "misinformation" is terrorism / an election crime.

The DHS is recent.
It only came about as a response to 9-11-2001.
The name is so: Inviting. It invites TRUST. (Who doesn’t want to trust Homeland Security?!) They make this so difficult.

Some were wise enough to foresee potential problems, specifically, U.S. gov abusing privileges against U.S. citizens.
NOW THIS.

It appears, the sins+crimes committed, 2016-2020, and continuing, are even worse than readily observed. Election interference.
