One of the problems with capital punishment is that newer, more sophsiticated techniques for investigating crimes have proven that a substantial percentage of people convicted of capital offences are in fact innocent.

By this argument, nobody should ever be incarcerated or punished for anything because they might be innocent.

That approach is working very poorly in society right now.

I don't think that's true.

If you are in jail and you are found innocent, you can be released. If you have been executed and you are found innocent, you cannot be brought back to life. And dead people are unable to testify when their testimony is needed.

Given that it takes 20+ years to execute death row prisoners, this doesn’t seem to be a very serious argument.
